Wayne Hays hiring his mistress were forced to talk to federal investigators. The newspaper said rejected "informal attempts" by investigators to meet with reporters Marion Clark and Rudy Maxa, who first wrote that the Ohio Democrat had put Elizabeth Ray on the federal payroll for sexual purposes.

The Post said investigators are considering asking Attorney General Edward H. Levi for permission to subpoena them. The FBI, the fraud division of the U.S. attorney's office, and the Public Integrity of the Justice Department are investigating Miss Ray's charge Hays put her on the committee staff while she was his mistress. There are "serious First Amendment problems with reporters being forced to step out of their role as reporters andtestify as to newsgathering techniques, material they obtained in their roles as reporters, notes or any news judgements," said Post attorney Christopher M.

Little. The newspaper said Miss Ray, through her attorney, asked the reporters who observed Hays and the woman at dinner together and listened to a telephone conversation between the two to support her testimony. "She freely gave us the story and she did not give it on the understanding there would be any testimony by any reporter to support anything she said," Little said in response to her request. Forcing reporters to testify about the sex scandal would be "inconsistent with the idea of a free press, he said. The Justice Department has a policy against attempting to force reporters to testify except as a last resort in a criminal investigations.
